A federal judge has struck down the Biden administrator’s retooled Title IX
A federal judge in Kentucky has blocked the Biden administration’s attempt to redefine gender in the Chapter IX as “gender identity”, reversing the change across the country.
The U.S. District Court for the Eastern District of Kentucky, Northern Division, issued its ruling in Cardona v. Tennessee on Thursday.

“Another big win for TN and the state!” Tennessee Attorney General Jonathan Skrmetti said in a post on X. “This morning, a federal court ruled in our favor and struck down the Biden administration’s radical new Rule IX nationwide.
“The court order is a major victory for protecting girls’ privacy in locker rooms and showers, and for the freedom to use biologically correct pronouns.”
The verdict came a few months after Supreme Court rejected the Biden administration’s urgent request to implement parts of the new rule that would include protections from discrimination for transgender students under Title IX.

The comprehensive rule was released in April and clarifies that Title IX’s ban on “sex” discrimination in schools covers discrimination based on gender identity, sexual orientation and “pregnancy or related conditions.”
The rule went into effect on August 1, and for the first time the law states that discrimination based on gender includes conduct related to a person’s gender identity.
That led more than two dozen state attorneys general to sue the rule, arguing it would run afoul of some of their state laws barring transgender students from participating in women’s sports.
“When Title IX is viewed in its entirety, it is abundantly clear that discrimination on the basis of sex means discrimination on the basis of being male or female,” the court’s opinion said. “As this court and others have explained, expanding the meaning of ‘sex-based’ to include ‘gender identity’ turns Title IX on its head.

“While Title IX sought to level the playing field between men and women, it abounds in exceptions that permit the separation of men and women based on persistent physical differences between the sexes.”
The decision came as Dream of Tommy TubervilleR-Ala., intends to push the Women and Girls in Sports Protection Act through the Senate.
A procedural vote on this will take place on Friday.
