“When you look at the magnets that attract people to America, citizenship is one of the greatest,” Graham said. “I also appreciate the executive order of President Trump to address the citizenship of Birthright. It is time for the United States to reconcile with the rest of the world and limit this practice once and for all.”
Currently, standard practice in the US is an automatic citizenship to all children born on American soil. It was a practice only since the 1960s, and is based on what some believe is the wrong interpretation of the 14th Amendment, in which it is “all persons born or naturalized in the United States, and susceptible to competence, citizens are from the United States and the states in which they live. “
Citizenship Law of Birth of 2025 would clarify that a “susceptible to jurisdiction” will be fulfilled, a person born in the United States must have at least one parent who is a citizen, a national, legal permanent resident or legal aliens serving in an American army on active duties.
The law explains that this would not affect the citizenship of anyone born before passing the law and would only limit the citizenship of those born to the United States.

This comes after Trump has signed an executive command entitled “Protection of the Meaning and Value of US Citizenship” on the first day in power. The order, which has been temporarily blocked by the judgment of the court, has ordered government agencies to refrain from issuing any documents that recognize the citizenship of any children born in the US with illegal and temporary migrants.
