An appeals court judge in New York denied the president-elect’s request on Tuesday Donald Trump to delay Friday’s sentencing for his conviction in a case involving hush money payments to a porn star before the 2016 election.
Judge Ellen Gesmer’s denial came shortly after she held a hearing on Trump’s request in Manhattan.
Trump’s lawyers have argued that Trump is entitled to a delay in the case because of a US Supreme Court ruling last year under which presidents have presumptive immunity from criminal charges for official acts taken while in office. The lawyers also argued that Trump would suffer irreparable harm and his constitutional rights would be violated if he were convicted 10 days before he was scheduled to be sworn in for a second term.
During the hearing, Gesmer was skeptical of these claims.
“After consideration of the submitted documents and extensive oral arguments, the petitioner’s request for temporary residence is denied,” the judge wrote in her ruling.
