If Trump signs such an order, it is expected as soon as on Thursday, it can significantly reduce the department. However, the entire agency may not be directly abolished if Congress does not adopt the legislature dealing with the laws established by the Department.

“President Trump does not have the ability to remove the federal department. Removing this required a congress action, including a supermia of 60 votes in Senate,” Stanmann told Fox News Digital. “So even if Trump can follow what he says, he has to retreat in some democrats in Senate, and that will probably be impossible.”

Jamie E. Wright, a political pundit and founder of the Wright law firm, also said before Fox News Digital that there could be obstacles to passing such a law.
“In order for such a bill to manage the law, the law is required by members of the Congress for the President’s Agent to smoothly progress by legislative proceedings – efforts that could present obstacles if opposition arises from legislators who believe that the Ministry of Education is crucial in providing permanent national educational guidelines and federal financing for the initiative for education,”
From his presidential campaign in 2024, Trump promised to work at the closure of the department during his second term, touching the education secretary Linda McMahon to run the agency to “get out of work” quickly.
During her hearing in February, McMahon admitted that the administration would need the Congress’s approval to move forward with the actions to abolish the agency.
“Certainly, President Trump understands that we will work with Congress,” McMahon told members of the Health, Education, Work and Senate Retirement Committee. “We would like to do it right. We would like to be sure to represent a plan that I think our senators could board, and our congress could board, which would have better function of the education department, but it certainly requires congress work.”
The administration has already taken steps to perform the department, starting with the cancellation of hundreds of millions of dollars in grants that finance diversity, equality and involvement in schools and reduce almost Half of his workplace.

Savannah Newhouse, a spokeswoman for the Ministry of Education, earlier told Fox News Digital in the midst of a decrease in the department, that “the goal of President Trump is reduced to reduce the federal bureaucracy and return of education in the countries because dollars and decisions should be closest to students.”
The department is currently monitoring some financial resources, managing student loans, financial assistance and implementation of non -discrimination policies in schools, while most education is engaged in the state level.
Newhouse added that “Despite the misconceptions, the education department does not control the school curriculum, decide on the payment of teachers, set who qualifies to help students and how much they get, manage schools or serve as a basic source of funds for schools.”
