Conservative judges of the court supported Newby’s opinion, including two who wrote a separate opinion that suggest that immunity found in federal law should be further narrowed.
The associated justice of Allison Riggs, a liberal who wrote a disagreement, said that the state constitutional claims should be left to federal law and criticized most of the court for “basically” unconstitutional “interpretation of the Constitution.
“Through a series of dizzy inversions, it explicitly transcribes an unambiguous statute for the exclusion of state constitutional claims from broad and inclusive immunity,” Riggs said.
