The federal judge ordered Trump’s administration to enhance tens of thousands of government employees released in recent weeks, in one of the highest legal difficulties with aggressive drive to reduce the cost of Elon Musk.
The command, executed by San Francisco William Alsup District, requested directly restoring trial employees in all agencies, including US treasury and defense departments and energy, after representatives of government workers claimed that they had been unlawfully discharged.
ALSUP found that the Staff Management Office, the Government Human Resources Agency that was one of the primary vehicles that used the so -called Musk Government Efficiency Department (Doge), he had no legal authority to order such dismissals.
At the hearing on Thursday, Alsup also criticized the US government for not sending an act of the OPM or any other official to answer questions about recent dismissals, despite the explicit request of the court, and expressed doubt about the Trump administration claim that they were fired with a weaker effect in their roles.
“The law is clear that OPM has no authority to order federal agencies to release their employees,” said Danielle Leonard, a lawyer in Altshuller Berzon, who represents prosecutors. “Today’s verdict is an important first step in holding this administration.”
Alsup’s order is the latest in a series of blows to Doge’s Crusader. Earlier this month, the Supreme Court supported the command, forcing the Government to pay for foreign assistance contracts in the amount of $ 2 billion that Trump’s administration tried to cancel, while the judges in the lower courts prevented Musk delegates from approaching some sensitive information.
The US government also crossed to clarify the directive published shortly after Trump’s inauguration regarding trial employees, emphasizing that it is to make staff decisions at some agencies. In a statement regarding Alsup’s order, the secretary of the Karolina Leavitt White House printing accused the judge of “trying to unconstitutionally take away the power of employment and cracking from the executive.”
She added: “If the judge of the Federal District Court wanted executive powers, they could try to run for themselves. Trump’s administration will immediately fight this absurd and unconstitutional order.”
