Quebec Judge of Rules 2 should face American extradition in fatal cases smuggling human smuggling

The Quebec Supreme Court judge ruled that two Akwesasna people should face the extradition of the US, where they face accusations associated with human smuggling that passed over the St. Lawrence, who ended up on March 29, 2023 by a drowning death by nine people.
Justice Gregory Moore said that the federal crown presented sufficient evidence to fulfill the low evidence for this phase of the extradition procedure.
“This is a very limited role and is intended only for deciding whether there is a case of Prim Facie, is there … a crime committed,” Moore said.
“The extradition judge did not listen to the trial, and the proceedings before the judge intended to be expeditious, [deciding] Just should the trial be held. “
The Federal Minister of Justice will finally decide on extradition.
Stephanie Square and Rahsontanohstha Delormier were sought in the US to face a charges filed with the US Federal Court for the Northern New York North District regarding the death of a four-member family from India and the Romanian Canadian family with two young children.
Although the alleged roles of Square and Delormier are very different in the tragedy, their cases have heard together during this phase of extradition procedure.
Romanian nationals Florian Iordache, Cristina Iordache and their two children born in Canada, Evelin, 2 and Elyen, 16 months, drowned on March 29, 2023, when the boat traveled in a covered storm on the St. Lawrence.
The ship was shared with a four -member family from India, Ocerek Rightundbhai Chaudhari, mother Dakshaben Chaudhari and their two adult children, son of Mitkumar and daughter Vidhiben. The boat was launched from the island of Cornwall headed to the southern shores of St. Lawrence, but he never succeeded.
The bodies of the two families were drawn from Rijeka between March 30 and 31.
The Casey Oakes body, a resident of Akwesasna, which was in Brod, was found in July.
Akwesensse is a Haudensaunee community separated by the border of Canada-now. It is located about 120 kilometers west of Montreal, and its territory is divided between Ontario, Quebec and New York State.
The Chaudhari family, in Canada on visas about visitors, paid $ 100,000, and Iordaches, faced with deportation, paid about $ 15,000 to smuggling people who allegedly led by a Montreal man named Tesingarazan Rasiah. Both families wanted to enter the USA
RCMP has accused Rasiah, who has been detained for numerous charges of smuggling human smuggling in June 2024.
The case goes to the Minister
This case now goes before the Federal Minister of Justice to determine whether they should transfer them to American Square, and Delormier has 30 days to submit temporary release and appeal. They can also apply to the Minister.
The decision to extradite the minister may be challenged at the level of the appeal court and the Supreme Court of Canada.
Square’s Montreal lawyer Joel Girard said he would directly regret the Federal Minister of Justice through a letter that he should refuse an extradition request. Girard asked whether the US had any jurisdiction to file a criminal complaint for death on Rijeka because they occurred in the Canadian territory.
“The alleged crime committed in Canada should be prosecuted in Canada,” Girard said.
Delormier -Montreal lawyer Antonio Cabral said he had planned to apply for a temporary edition for Delormier. Cabral said he also plans to complain about Moore’s decision and look for a gladue report for Delormier. Girard said he would also endeavor to send a Minister Report for Square.
Gladue reports are basically like a statement before a sentence that include the historical impact of scattering and colonialism on the life of indigenous offenders. However, there is a case law of the use of a gladaus report in the extradition procedure.
Cabral said he was planning to fight Delormier’s extradition “with all my power and energy.”
Square faces eight dots in the indictment, including the smuggling of aliens, a conspiracy to commit foreign smuggling, smuggling aliens for profit and four points of alien smuggling point that cause death for each of the Romanian-Canadian families who died.
Delormier faces five dots, including a conspiracy to commit foreign smuggling, smuggling aliens and smuggling aliens for profit.
A large part of the American case against Delormier and Square is based on the evidence collected by Canadian authorities, according to publicly available minutes. Square was a alleged organizer of running who allegedly hired Casey Oakes to take over two families across the river.
Delormier was found on the island during the day of March 30 on the verge of hypothermia. The extradition files state that he piloted the boat that bought Square, which broke on the way to the island of Cornwall, where families were waiting for the smugglers to be smuggled.
