Chelsea’s striker Sam Kerr was cleaned with racially difficulty harassment after calling a metropolitan police officer “stupid and white.”
The Australian internationary commented on PC Stephen Lovell during the incident in the southwest of London in the early hours of January 30, 2023.
Mrs. Kerr, 31, and her partner, midfielder West Ham Kristie Mewis, drank when a taxi driver drove them to a twickenham police station who complained that they refused to pay the cleaning costs after one of them was ill and that of them broke the rear window of the vehicle.
At Mrs. Kerr’s police station, she became “violent and offensive” according to PC Lovell, calling him “f ****** stupid and white.”
The jury on Tuesday returned the verdict to be guilty after discussing about four hours and 17 minutes at the Crown Court Kingston from the previous day.
Judge Peter Lodder KC said after the verdict: “I suppose her own behavior has significantly contributed to the presentation of this allegation.
“I’m not going behind a jury verdict, but that has a significant impact on the issue of costs.”
Mrs. Kerr did not show any emotion during the reading of the verdict, but she gave her thumbs to her lawyer Grace Forbes after the judge left.
During the trial, the court heard that Mrs. Kerr accepted later by calling PC Lovell “Stupid and White” during a fierce exchange, but denied that it was charges.
She said she regretted the way she was expressed, but she added, “I feel the message is still relevant.”
She denied the use of “whiteness as an insult” and claimed: “I believed that he used his power and privilege over me because he accused me of something I didn’t … I tried to express it because of power and privilege they would have never had to understand what we just went through and the fear we had for our lives. “
Asked if PC Lovell speaks “stupid because he was white,” Mrs. Kerr said, “No.”
Mrs. Kerr and her partner Ms. Mewis told the court that they felt “fired” by PC Lovell after explaining that they were “trapped” in the back of a taxi and “held against our will”.
Mrs. Mewis broke the back window of the taxi before the couple climbed from the vehicle, which was parked near the Twickenham Police Station.
At the station, Mrs. Kerr, her partner and PC Lovell entered the exchange, described in court as “a fierce argument”, and Ms. Kerr told the police “This is a racial thing”.
She said the jury: “I believed that she treated me differently because of what they considered to be the color of my skin – especially the behavior of PC Lovell.
“The way he accused me of lying and later arrested me for criminal damage even though Kristie said it was just the one (who broke the taxi window).
“At the time, I thought they were trying to put it on me on me.”
The Crown Prosecutor’s Office originally decided not to accuse Mrs. Kerr, he listened to the court.
It can now be reported that the legal team of Mrs. Kerr tried to throw out the case at a preliminary hearing, claiming that there was a misuse of the process by the prosecutor.
Speaking during hearing on January 14, lawyer Ms. Kerr Grace Forbes said that CPS had violated his own guidelines, adding that the “hole” was used in the scheme of the victim’s right to justify the prosecution’s proceedings one year after the alleged criminal offense.
During the trial, it was put on PC Lovell that he only made a statement stating that Mrs. Kerr comments caused an alarm or harassment after that decision.
In his first statement, CPS did not mention the “stupid and white” comment that has an impact on him, the jury said.
Police filed a request for reviewing the CPS decision not to prosecute, and she replied that the outcome would be limited to an apology, the court listened.
Prosecutors later requested further evidence, and the second statement of PC Lovell was submitted in December 2023, mentioning the alleged influence.
He read part of the statement to the court, who said the comments made him “shocked, upset and (left me) feeling humiliated.”
The charge was approved later in December 2023, almost a year after the incident.
Mrs. Forbes told PC Lovell during the cross-examination: “You were determined to persecute this person, right?”
PC Lovell said “Yes,” and Mrs. Forbes asked, “Through the criminal courts?”
The cop again answered “Yes”.
