Judge Kirstin Hamman announced on Friday that Cordiro had left the punishment and would be released from custody. She ruled that new evidence, including DNA test results, is likely to change the outcome of the second trial.
District prosecutor Maui Andrew Martin said he was planning to complain and ask that he was guaranteed to be handed over to Cordeira.
Cordeiro’s The first trial Ended in a jury hanged, because only one juror voted to condemn him. He was later found guilty of murder, robbery and attempted murder, and was sentenced to life without a conditional discharge.
