Red State AG applauds Trump’s crackdown on illegal immigration after four-year battle with Biden

FIRST ON FOX: Twenty Republican state attorneys are ready to strengthen President-elect Trump’s crackdown on illegal immigration, according to a joint statement shared by Kansas Attorney General Kris Kobach with Fox News Digital.

“The Biden administration has taken dozens of executive actions that have weakened border controls and sanctioned illegal immigration from around the world,” the letter said.

“Republican attorneys general retaliated by taking the Biden administration to court for ending the Trump administration’s successful immigration policies and replacing them with new policies that broke the law and encouraged illegal immigration. Republican attorneys general prevailed on nearly every one of these bills.”

AGs say they are ready to roll back Trump’s “America First” policies from the Trump first administration, particularly his “Remain in Mexico Policy” and mass deportations.

“As we point out in this letter, The policy of staying in Mexico is something that’s in the federal statute, and it’s been in the federal statute since 1996. President Trump was the first president to actually implement that policy that was set by Congress,” Kobach told Fox News Digital in an interview.

“President Trump has all the legal tools he needs,” he added. “They’re already in the federal code, and that’s what we’re saying as well. As lawyers trying to stop the Biden administration from breaking the law, we’re saying, ‘President Trumpyou have our support and you have a wide-open runway ahead of you to restore enforcement of our federal immigration laws.'”

The attorneys general also expect Trump to “completely reverse the illegal DACA programs,” as he promised during his first term. Deferred Action for Childhood Arrivals (DACA) the program, introduced in 2012 by the Obama administration, allows illegal immigrants who were brought to the country as children — often called “Dreamers” — to stay in the country temporarily.

In addition to Kobach, attorneys general from Alabama, Alaska, Arkansas, Florida, Louisiana, Idaho, Indiana, Iowa, Mississippi, Missouri, Montana, Nebraska, New Hampshire, North Dakota, Oklahoma, South Carolina, South Dakota, West Virginia and Tennessee signed the statement .

Republican attorneys general across the US were in the lead filing lawsuits against the Biden administration over the past four years. This month, Texas AG Ken Paxton filed his 103rd lawsuit against the outgoing administration over residential energy efficiency standards.

Republicans have secured several legal victories. In 2021, a coalition led by then-Louisiana Attorney General Jeff Landry won a preliminary injunction against the administration’s suspension of new oil and gas leases on federal land. In May 2024, Paxton won a landmark victory in a lawsuit alleging illegal censorship by the administration, with a federal judge denying the government’s motion to dismiss and ordering expedited discovery.

i.a federal judge recently overturned the Title IX administrative rule, which expanded protections against discrimination based on gender identity, after challenges from Republican-led states.

“I think the 20 or so attorneys general who signed this statement are talking about what the law is and what the law requires,” Kobach said. “And … we are very grateful and expect that President Trump will return us to a country where the law is enforced and the restrictions that Congress has put in place are respected.”
